The provisions described here govern your access to and use of any website, mobile site, social media platform, software, email communication, or other digital service owned or operated by Dr. Squatch LLC or its related entities. This covers all services, features, pages, functions, transactions, orders, sales, purchases, and product acquisitions offered through the platform, collectively called the Service. Please read the dispute resolution section carefully, since it requires you to mediate and arbitrate certain disputes and limits how you may seek relief from us.
These provisions are supplied in English, and we do not guarantee the accuracy of any translated versions. Translations are for convenience only, and if there is any conflict, the English version governs. You may access the English version by returning to the home page of your selected country, choosing the English link at the top, and then clicking the terms link at the bottom. By using the Service, you acknowledge that you have read, understood, and agreed to these provisions without limitation or qualification. You also consent to our privacy policy, which is incorporated by reference. Internet transmissions are never completely private or secure, and you assume the risk of security breaches. Registered users must protect their account credentials and notify us immediately if they suspect compromise. Do not send sensitive personal information. If you do not accept these provisions or the privacy policy, you must stop using the Service immediately.
By using the Service, you represent that you are at least the legal age of majority in your jurisdiction. The Service is not intended for children under eighteen, and anyone under eighteen is not authorized to use it. We may change these provisions at any time at our sole discretion. Changes take effect immediately upon posting, and your continued use means you accept them. It is your responsibility to check for updates. These provisions affect your legal rights and obligations, limit our liability, require you to indemnify us, and require certain disputes to be settled through arbitration.
The Service and all content, including copyrights, patents, trademarks, service marks, trade names, logos, text, design, graphics, icons, images, audio, downloads, interfaces, code, software, and their selection and arrangement, are owned or controlled by Dr. Squatch, our licensors, or certain third parties. You are granted a limited, revocable, non-transferable license to temporarily download one copy for personal, non-commercial viewing only. You may not modify, copy, use commercially, publicly display, decompile, reverse engineer, remove proprietary notices, or infringe our intellectual property rights. This license terminates automatically if you violate these restrictions and may be terminated by us at any time. You must destroy any downloaded materials upon termination.
We own and use many trademarks, including Dr. Squatch, its logos, trade dress, Bricc, Smell Like a Champion, Get Dirty Stay Clean, Smell the Squatch, and various scent names. Some features may allow you to submit content such as comments, reviews, or quiz responses. By submitting user content, you grant us a perpetual, worldwide, irrevocable, non-exclusive, royalty-free license to use it in any manner, including derivative works, without compensation or notice. Your content may be posted at your own risk, and we cannot control how others use it.
You agree not to violate any law, infringe intellectual property or privacy rights, interfere with or damage the Service, scrape or crawl pages, mirror or frame the Service, access non-public areas, probe vulnerabilities, bypass security measures, decompile software, or assist others in doing so. We may modify, suspend, or terminate the Service at any time without notice.
Shipping and returns are governed by our shipping and return policies, incorporated by reference. The Service and all goods and materials are provided as is without any express or implied warranties, including satisfactory quality, merchantability, fitness for a particular purpose, non-infringement, and title. We do not guarantee accuracy, completeness, or error-free operation. You bear all risks associated with use, including reliance on information. We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, loss of use, data, or intangible losses, even if advised in advance. Our maximum aggregate liability is the amount you paid us in the three months preceding the claim. Some laws may not allow these limitations, so they may not apply to you. You waive unknown claims under California Civil Code Section 1542 to the extent applicable.
You agree to indemnify, defend, and hold harmless Dr. Squatch and its officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses arising from your use of the Service or violation of these provisions. The Service may link to third-party sites, which we do not review or control. We are not responsible for their content, and use is at your own risk. References to third parties do not imply endorsement.
These provisions are governed by the laws of the United States and California, without regard to conflicts of laws. Any litigation must be in state or federal courts in Los Angeles County, California. You consent to service by email. Disputes must first go through non-binding mediation in Los Angeles County, with costs split and each party bearing its own attorney fees. The defendant may waive mediation. If mediation fails, disputes shall be resolved by binding arbitration administered by the American Arbitration Association under its commercial and consumer rules, as modified by these provisions. There shall be one arbitrator, or three if requested. You waive the right to court resolution, except for intellectual property injunctions, agency enforcement, or injunctive relief in court. Arbitration shall be in English and confidential.
No class arbitrations, class actions, or representative actions are permitted. Disputes must be resolved individually. The arbitrator has exclusive authority over procedural and substantive decisions, including arbitrability, and may grant remedies available in court, but may not conduct class or representative proceedings or award punitive or non-compensatory damages. Any permitted court proceeding must be in Los Angeles County, California, and you waive jury trial. Claims must be brought within one year. If material arbitration provisions are invalid, the entire arbitration section ceases to apply.
You and Dr. Squatch agree that claims may only be brought individually, not as a plaintiff or class member. The arbitrator cannot hear class, consolidated, representative, or private attorney general actions. If the class waiver is found void, such claims must be heard in a court of competent jurisdiction in Delaware, not arbitration.
